Another twist in the HIPs tale comes with RICS stating the packs might not be provided but merely "ordered" - 20 June 2007

 

 

 

The news regarding Home Information Packs is seldom positive nowadays and once gain we have some bad press to deal with as RICS suggest that some vendors (sellers) will merely order or apply for a pack but never actually obtain one.

 

The fear is that a loophole has been created whereby a seller can still market the property but if a buyer is found swiftly (before the pack is delivered) then the pack will not be necessary. The Government is allowing people to market their home without the HIP in place whereas initially the pack was a mandatory requirement prior to putting the property on the market.

 

This could lead to arguments over searches as anyone purchasing a 4 bed house from the 1st August 2007 might reasonably expect the vendor to acquire the searches which is a requirement of the HIP legislation. Yet the vendor may refuse and place the burden back on the buyer.

 

The Energy Performance Certificate (EPC) will still have to be provided by the seller by the time contracts are exchanged.
